Earning Loyalist points is easy.

• Just get started. You will receive introductory Loyalist points simply for signing up and registering your account.
• Earn points on purchases. When you complete a purchase of eligible items totaling $25 or more, CompetitionStyle will automatically add the corresponding Loyalist points to your account. Points are assigned to eligible products and are not assigned to gift cards, services, taxes, shipping, or fees. You may see the number of Loyalist points assigned to an item on its product page. Similarly, you may see the total Loyalist points for an entire purchase in the Shopping Cart.
• Earn bonus points when you complete your first order.
• Earn bonus points on eligible purchases totaling $100 or $200 or more.
• Earn bonus points during occasional promotional periods.
• Earn points for reviewing your purchases.

Note: If a purchase is returned, points earned on that purchase will be deducted from the customer’s point balance.

You may review your Loyalist point balance at any time by selecting My Account from the navigation menu. On the My Account page you will find a tab labeled My Loyalist Points which will provide access to a summary of your current balance of points.

The My Loyalist Points tab also permits you to redeem your points for Store Credit as described below.

Loyalist points become available for redemption 10 days after the purchased items have been completed and shipped.

There are two ways to redeem Loyalist points: 1. on the Checkout page; and 2. on your My Account page within the My Loyalist Points tab.

Redeem on the Checkout Page

When checking out, you will notice — beneath the tabulation of the items, shipping, tax, and total — a note asking if you would like to apply Loyalist points to your order.  If you would like to do so, simply follow the instructions.

Note: This option will only be presented if your points balance is sufficient to permit a reward. The minimum eligible purchase amount to redeem points is $50. The minimum number of points that may be redeemed is 500 points. The maximum number of points that may be redeemed is 50,000.

Redeem on the My Account Page

Select My Account from the navigation menu, and then the My Loyalist Points tab. Within the My Loyalist Points tab you will be able to see your current balance of Loyalist points. You will also be able to redeem your Loyalist points and convert them to Store Credit. This Store Credit will then be available for you to apply to your future purchases on the Checkout page.

Note: The minimum number of points that may be redeemed is 500 points. The maximum number of points that may be redeemed is 50,000.

This CompetitionStyle Loyalist Rewards Program Terms and Conditions agreement (these “Rewards Terms”) is between FisherAtlantic Co. and its affiliated entities, owners, officers, employees and authorized agents (collectively, the “COMPANY,” “we,” “us” or “ours”) and you, the person accessing this website, and your agents (“you” or “yours”) for the use of this website (the “Site”).

These Rewards Terms set forth the terms and conditions, including an agreement to individual arbitration of all disputes, applicable to the Loyalist Rewards Program (the “Rewards Program”” or “Program”) offered through the Site.

BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE REWARDS TERMS AND COMPANY’S TERMS OF USE AND PRIVACY POLICY. PLEASE READ THESE REWARDS TERMS, THE TERMS OF USE, AND PRIVACY POLICY CAREFULLY AND KEEP A COPY FOR YOUR RECORDS. DO NOT PARTICIPATE IN THE REWARDS PROGRAM IF YOU DO NOT AGREE TO THESE REWARDS TERMS, THE TERMS OF USE AND COMPANY’S PRIVACY POLICY. WE SUGGEST YOU REVIEW THESE REWARDS TERMS AND COMPANY’S TERMS OF USE AND PRIVACY POLICY PERIODICALLY, AS THEY MAY BE UPDATED FROM TIME TO TIME.

THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT, AS SET FORTH IN THE SECTION ENTITLED “DISPUTE RESOLUTION—ARBITRATION IF A DISPUTE ARISES” BELOW, REQUIRES YOU TO ARBITRATE CLAIMS YOU MAY HAVE AGAINST COMPANY ON AN INDIVIDUAL BASIS, MEANING YOU CANNOT BRING CLAIMS AGAINST COMPANY IN COURT, AND CONFIRMS YOUR AGREEMENT TO A CLASS ACTION WAIVER IN ARBITRATION. IT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.

The Rewards Program is subject to change, alteration, or discontinuation at our discretion. Participating, attempting to participate, or seeking rewards under the Program constitutes acceptance of the then-current Rewards Terms. We may stop offering the Program or make changes to it at our discretion without notice to you.

PROGRAM MEMBERSHIP QUALIFICATIONS

You must be at least eighteen (18) years of age and reside in the United States (“U.S.”) in order to register for the Program. Only individual retail consumers may register for the Program, and each individual is limited to one Rewards Program account. Rewards Program accounts cannot be shared, combined or transferred. The Rewards Program is limited to individuals participating for their own personal benefit, and not for corporate, commercial or resale purposes. COMPANY employees are not eligible to participate in the Program.

COMMUNICATIONS REGARDING THE PROGRAM

By participating in the Program, you agree to receive communications from COMPANY, including emails and push notifications, regarding the Program and concerning offers and promotions that may be of interest to you. If you opt out of receiving emails, you may be precluded from participating and receiving the benefits of the Program. We may also send you text messages where you have provided prior express written consent. You are responsible for keeping your contact information up to date with COMPANY. Lost, stolen or expired Rewards (as defined below) or Points (as defined below) will not be replaced. COMPANY is not responsible for communications, including Points, Rewards, or Promotional Offers (as defined below) lost due to change of address or changes in other contact information.

ENROLLMENT AND VERIFICATION FOR THE PROGRAM

You may enroll in the Program and create your Rewards Program account (“Account”) via the Site. We will ask you to provide your first name, last name, email, and phone number. You will also be asked to choose a password.

EARNING POINTS

After you enroll and verify your Account, you will be eligible to receive Points on Eligible Purchases (defined below) as follows or as otherwise set out in promotions and communications that we send to you or display on our Site as part of the Rewards Program.

Point allocation per dollar spent: $1.00 spent = 30 Points.

Eligible Purchases of merchandise (amounting to $25.00 or more, after promotional offers, Point redemptions, discounts and Store Credits have been applied, before taxes, shipping charges and other fees have been applied and minus returns, refunds or credit adjustments) made online at the Site and shipping to addresses and P.O. Boxes in the continental U.S. and Hawaii count toward your Point accrual.

Your ability to receive Points may be subject to certain exclusions that may apply for particular categories or products. You will not receive Points for charitable donations, for purchases made when you redeem Store Credits, or for the dollar value of Points redeemed, discounts, rewards, credits, shipping, taxes and fees. In order to receive Points for your spend on the Site, purchases must be made after logging into your Account on the Site. Purchases made as a “guest” or under a different Account do not qualify for Points.

Points received for items that are returned will be deducted from your Points balance at the time of the return.

There are additional ways to interact and engage with the Program to earn points.

• You earn 1000 Points when you register for an account. You can only earn these Points once per lifetime.
• You earn 1500 Points when your first order of $50 is completed and shipped. You can only earn these Points once per lifetime.
• You earn a bonus 1500 Points for spending a minimum $100 or 4000 Points for spending a minimum of $200 on qualifying purchases in a single order.

CONVERSION OF POINTS INTO PURCHASING VALUE

Points can be redeemed for purchasing value on the site as set out as follows:

1000 Points = $1.00 purchasing value.

For purchases made on the Site, Points received will be considered pending, and cannot be redeemed for new purchases, until ten (10) days after the qualifying purchases have shipped.

We reserve the right to change the Points conversion above without notice and at our discretion or to offer other incentives and offers in exchange for Points.

PROMOTIONAL OFFERS

Separate from the ability to receive Points and Rewards as described above, we may post certain promotional offers (“Promotional Offers”) to your Account or send them to you by email or another means. Promotional Offers will be subject to the terms and conditions of each respective Promotional Offer, including, without limitation, qualifying purchases and applicable expiration dates.

REDEMPTION OF POINTS AND REWARDS

Email verification is required for you to be able to participate in and redeem Points or Rewards with the Program.

Points may be redeemed in amounts of 1000 Points or more on purchase totaling $50.00 or more.

Points cannot be used on orders shipped outside of the continental U.S. and Hawaii.

You do not own or have any property or other interest in Points or Rewards, which can be changed or eliminated by COMPANY at its discretion at any time. Points have no cash value and are not legal tender. You may not redeem Points or Rewards for cash, except as required by law in which case the value of a Reward or the total Points balance is 1/100 cent.

Points may not be used towards the purchase of gift cards or other services.

EXPIRATION OF POINTS, REWARDS, AND PROMOTIONAL OFFERS

All Points will expire after 730 days of inactivity, defined as the period since the customer last redeemed Points or received Points from a purchase. Rewards and Promotional Offers shall expire in accordance with their respective terms and conditions.

RETURNS

Merchandise returns must be made in accordance with COMPANY’S return policy available at https://competitionstyle.com/products-orders-returns. Points received for items that are returned will be deducted from your points balance at the time of the return. If you return any merchandise that was purchased with a Reward, you will not receive the Reward back as part of your return.

PROGRAM BENEFITS

Loyalist Rewards Program benefits are described below and will be updated periodically by COMPANY. Members are eligible for certain Program benefits. In addition to any other requirement and/or limitation that may be communicated to you at the time a benefit is offered, the following shall apply:

• Free Shipping

Free shipping is available for Program members on qualifying purchases from the Site. Free shipping is available on orders shipping to addresses and P.O. Boxes in the continental U.S. and Hawaii only. You must be signed in to your account at the time of purchase in order to take advantage of the free shipping benefit. Offer cannot be applied to previous purchases and cannot be redeemed for cash. Terms of offer are subject to change.

• Coupon and Promotional Offer Rewards

As a member of the Program you will be eligible to receive coupons and promotional offers limited to Program members. Such Rewards may be communicated to you through email, your Account on the Site, the Loyalist Rewards & Coupons page, or other means. These Rewards are non-transferable. Additional terms and conditions may apply.

UNAUTHORIZED ACCESS OR USE

We are not responsible for any unauthorized access to your Account or any unauthorized use of any Points, Reward or Promotional Offer in your Account. If you believe any such unauthorized access or use has occurred, you may notify us at competition_style_team@competitionstyle.com. Upon receipt of such notification, we will help you to set up a new Account and transfer your existing Points balance (if any).

BALANCE INQUIRY AND TRANSACTION HISTORY

You may check the Available Points Balance and Rewards via the Site. Your Available Points Balance shall equal the amounts reflected in our records.

CANCELING YOUR MEMBERSHIP IN THE PROGRAM

You may cancel your membership in the Program by contacting us at competition_style_team@competitionstyle.com. Once you have opted out of the Program, you may not receive additional Points in your Account, and the Available Points Balance in your Account shall expire immediately.

NO TRANSFERS

Points, Rewards and Promotional Offers may not be transferred.

REVOCATION AND TERMINATION OF ACCOUNT OR PROGRAM

We reserve the right to cancel, terminate, suspend, or revoke your Account, remove any points, or void any reward at any time in our discretion for breach of these Terms, any other reason or no reason, without prior notice, subject to applicable law. Upon cancellation, termination, suspension, or revocation of your Account, you may not receive additional Points in your Account, and any Rewards or Promotional Offers in your Account shall expire immediately.

We reserve the right to cancel, terminate, or suspend the Program at any time in our discretion, upon thirty (30) days’ prior notice. Upon cancellation, termination, or suspension of the Program, you may not receive additional Points, and the Available Points Balance in your Account shall expire immediately. Upon cancellation, termination, or suspension of the Program, you may continue to redeem any Rewards or Promotional Offers in your Account prior to their applicable expiration dates. We also reserve the right to change any aspect of the program without notice.

DISPUTE RESOLUTION—ARBITRATION IF A DISPUTE ARISES

YOU AND COMPANY AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, ALSO MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION.

Mindful of the low price of items sold and purchased on the Site and the high cost of legal disputes, not only in dollars but also in time and energy, both you and COMPANY agree that any controversy, claim, action, or dispute between you and COMPANY, its affiliated companies and their respective officers, directors, employee, agents or contractors arising from or relating to the Program (“Dispute”), will be resolved by this dispute resolution procedure and arbitration agreement (“Arbitration Agreement”).

INFORMAL DISPUTE RESOLUTION

Prior to initiating any arbitration, you must first present any Dispute to COMPANY by contacting us at competition_style_team@competitionstyle.com to allow for an opportunity to resolve the Dispute. You or we may initiate arbitration if your Dispute cannot be resolved within sixty (60) days.

Both you and COMPANY agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any arbitration or filing any claim against the other party.

RIGHT TO BRING SMALL CLAIMS IN COURT

Instead of arbitration, either you or COMPANY may bring any individual claim in small claims court consistent with the jurisdictional and dollar limits that may apply, as long as it is brought and maintained as an individual claim.

HOW ARBITRATION WORKS

Either party may initiate arbitration, which shall be conducted by the American Arbitration Association (“AAA”) pursuant to its Consumer Arbitration Rules (“AAA Rules”), as modified by this Arbitration Agreement. The AAA Rules are available on the AAA’s website www.adr.org, or by calling the AAA at (800) 778-7879. In the event the AAA is unavailable or unwilling to hear the Dispute, the parties shall agree to another arbitration provider. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s applicable rules, unless you are represented by a lawyer or group of lawyers who have brought, are bringing, or intend to bring more than fifty (50) arbitrations against COMPANY that are similar in nature, in which case the parties shall negotiate fees for each individual case with the AAA before any filing occurs and may mutually select a different arbitration service if that negotiation is unsuccessful. COMPANY will reimburse your arbitration filing fee in an amount up to $1,000 if you are successful in your claim or if the arbitrator determines that even though you were not successful, the claim was brought by you alone and not in combination with others represented by the same lawyers and was brought in good faith with a reasonable belief in the claim after a reasonable effort to resolve the matter with COMPANY before bringing the claim. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in Manhattan, New York, New York.

WAIVER OF RIGHT TO BRING CLASS ACTIONS AND REPRESENTATIVE CLAIMS

All arbitrations shall proceed on an individual basis. The arbitrator is empowered to resolve the Dispute with the same remedies available in court, however, any relief must be individualized to you and shall not affect any other customer. You and COMPANY agree that each may bring claims against the other in arbitration only in your or their respective individual capacities and in so doing you and COMPANY hereby waive the right to a trial by jury, to assert or participate in a class action lawsuit or class action arbitration (either as a named-plaintiff or class member), and to assert or participate in any joint or consolidated lawsuit or joint or consolidated arbitration of any kind. If a court decides that applicable law precludes enforcement of any of this paragraph’s limitations as to a particular cause of action, then that cause of action (and only that cause of action) must remain in court and be severed from any arbitration.

OTHER TERMS

This Arbitration Agreement shall be governed by, and interpreted, construed, and enforced in accordance with the Federal Arbitration Act and, where applicable, the law of the State of New York. The terms of the Arbitration Agreement provisions shall survive after your relationship with COMPANY and/or participation in the Program ends. Any arbitration will be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. Except as set forth above, if any portion of this Arbitration Agreement is deemed invalid or unenforceable, it will not invalidate the remaining portions of the Arbitration Agreement.

DISCLOSURE OF INFORMATION TO THIRD PARTIES

We only share your personal identification information in accordance with our Privacy Policy.

AMENDMENTS

To the extent permitted by law, we may amend these Rewards Terms at any time by posting updated or revised Rewards Terms at www.competitionstyle.com/loyalist-coupons-store-credit or elsewhere on the Site. Please check frequently for any updates or revisions to these Rewards Terms. Unless otherwise indicated by us, any amendments shall apply to any transactions occurring on or after the effective date of the amendments. Except where prohibited by law, the receiving of Points or the redemption of any Points, Reward or Promotional Offer after the effective date of any amendment shall confirm that you agree to the amendment.

NOTICE OF FINANCIAL INCENTIVE

In connection with the Rewards Program, we may offer financial incentives and/or price or service differences (“Incentives”) to Rewards Program members based on points earned as further described in these Terms, in exchange for our use of your personal information.

To offer these Incentives, we must track the personal information you provide when you sign up or engage in activities to earn Points, such as purchase history, date of birth, participation in COMPANY events, and engagement with COMPANY as described in these Terms (“Loyalist Rewards Program Data”).

The value of Loyalist Rewards Program Data is calculated by determining the approximate additional spending per Loyalist Rewards Program member, per year compared to individuals who are not yet enrolled in the Rewards Program. The value of Loyalist Rewards Program Data is reasonably related to the costs associated with offering the Incentives. You can join the Rewards Program at www.competitionstyle.com, and you can withdraw from or cancel your Rewards Program membership at any time by contacting us at competition_style_team@competitionstyle.com.
